About these terms

These Terms and Conditions (the “Terms”) apply to your use of services.kinifymarket.com (the “Platform”), a website of the KINIFY brand, owned by Roccelh LTD, a private limited company registered in England and Wales (company number 16729000, registered office: 128 City Road, London, EC1V 2NX, United Kingdom), and operated with its subsidiary Roccelh RDC in the Democratic Republic of the Congo (together “Kinify Services”, “we”, “us”). By creating an account or using the Platform, you agree to these Terms. If you do not agree, please do not use the Platform.

Our role

Kinify Services is an online marketplace that connects people looking for a service (“Clients”) with independent professionals who offer their services (“Professionals”).

  • Professionals are independent. They are not employees, agents or representatives of Kinify Services.
  • The agreement for a job (work, price, timing, quality) is made directly between the Client and the Professional. Kinify Services is not a party to that agreement.
  • We provide the tools to find, compare, contact and, where available, book Professionals.

Your account

  • You must be legally able to enter into a contract to create an account.
  • The information you give us must be accurate and kept up to date.
  • You are responsible for keeping your password confidential and for all activity on your account.
  • Tell us straight away if you think your account has been used without your permission.

Listings and Professionals

  • Professionals are responsible for the content of their listings, including descriptions, prices, photos and the areas they cover, and must follow our Provider Guidelines.
  • Professionals must hold any licence, permit or qualification required for the services they offer.
  • A Verified badge shows that a Professional has passed our verification checks. It does not guarantee the quality or result of any job.
  • We may edit, suspend or remove a listing that breaks these Terms or our guidelines.

Bookings and payments

  • When a listing offers booking, the service, options and amount due are shown before you confirm.
  • Payments can be made by Orange Money, M-Pesa, Airtel Money or bank card. Cash payment may be possible in some cases, depending on the Professional and the service.
  • Keep proof of every payment you make.
  • Fees for any paid plan or promotion for Professionals are shown before purchase.

Cancellations and refunds

Cancellations and refunds are handled as described in our Refund Policy. For jobs agreed directly with a Professional, the conditions agreed between you and the Professional apply.

Reviews

  • Reviews must be honest, respectful and based on a real experience with the Professional.
  • Fake reviews, paid reviews and reviews written by Professionals about themselves are not allowed.
  • We may remove reviews that break these rules or the law.

Prohibited conduct

You must not:

  • offer or request illegal services, or publish false or misleading information;
  • use a fake identity or another person’s account;
  • harass, threaten or discriminate against other users;
  • send spam, or try to collect other users’ data without their consent;
  • interfere with the security or normal operation of the Platform.

Content and intellectual property

  • You keep the rights to the content you publish (texts, photos, reviews). You allow us to display and use it on the Platform and to promote the Platform.
  • You must only publish content that you own or have permission to use.
  • The KINIFY and Kinify Services names, logos and the design of the Platform belong to Roccelh LTD and may not be used without our permission.

Liability

  • Professionals are solely responsible for the services they provide. Kinify Services is not responsible for the quality, safety or legality of the work, or for disputes between Clients and Professionals.
  • We work to keep the Platform available and secure, but we cannot guarantee that it will always be available or free of errors.
  • To the extent permitted by law, Kinify Services is not liable for indirect losses arising from the use of the Platform.

Suspension and termination

You can close your account at any time by contacting us. We may suspend or close an account that breaks these Terms, our guidelines or the law, or that puts other users at risk.

Privacy

We use your personal data as described in our Privacy Policy and Cookie Policy.

Changes to these Terms

We may update these Terms. The date at the top of the page shows the latest version. If you keep using the Platform after a change, you accept the updated Terms.

Governing law

These Terms are governed by the laws of the Democratic Republic of the Congo. Any dispute will first be handled amicably; failing that, it will be brought before the competent courts of Kinshasa.
